1. Acceptance of Terms

By accessing or using PhotoCompliance ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. These Terms constitute a legally binding agreement between you and PhotoCompliance ("we," "us," or "our").

2. Description of Service

PhotoCompliance is a SaaS platform that provides compliance checking and repair services for US passport photos. Our Service allows users to:

• Check whether uploaded photos meet US passport photo requirements
• Receive structured diagnostic reports on photo compliance
• Access automated photo repair capabilities
• Download processed photos meeting submission standards

3. User Accounts

To access certain features, you must create an account. You are responsible for:

• Maintaining the confidentiality of your login credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized use
• Providing accurate and complete information during registration

We reserve the right to suspend or terminate accounts that violate these Terms.

4. Acceptable Use

You agree to use the Service only for lawful purposes. You shall not:

• Upload photos containing inappropriate, offensive, or illegal content
• Attempt to breach, circumvent, or reverse engineer our systems
• Use automated scripts, bots, or scrapers without authorization
• Upload photos of individuals other than yourself without their consent
• Resell, redistribute, or transfer access to the Service
• Upload photos that infringe on intellectual property rights
• Use the Service for any fraudulent or deceptive purpose

5. Photo Upload and Processing

When you upload photos to our Service:

• You retain all rights to your photos
• You grant us a limited license to process your photos as part of the Service
• Photos are processed temporarily and stored for a maximum of 7 days
• You confirm that you have all necessary rights to upload and process the photos
• You will not upload photos containing malicious code or viruses

6. Service Availability and Modifications

We strive to maintain high availability of our Service, but we do not guarantee uninterrupted access. We reserve the right to:

• Modify, suspend, or discontinue the Service at any time
• Update features, functionality, or pricing with reasonable notice
• Perform scheduled or emergency maintenance
• Limit usage or storage capacity as necessary

7. Pricing and Payment

Paid features are subject to the following terms:

• All fees are displayed in US Dollars and are subject to change with notice
• Payments are processed through third-party payment providers (Stripe/Creem)
• You authorize us to charge your designated payment method for all fees
• Refunds are subject to our Refund Policy

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PHOTOCOMPLIANCE AND ITS AFFILIATES SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, or business opportunities
• Any damages arising from reliance on the Service or its outputs
• Any government agency's decision to reject or approve a photo
• Technical failures, errors, or interruptions in the Service

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

10. Indemnification

You agree to indemnify, defend, and hold harmless PhotoCompliance and its affiliates from any claims, damages, losses, or expenses (including legal fees) arising from:

• Your violation of these Terms
• Your misuse of the Service
• Photos you upload, including claims by third parties
• Any fraudulent or illegal activity conducted through your account

11. Intellectual Property

The Service, including its design, features, algorithms, and content, is owned by PhotoCompliance and protected by intellectual property laws. You retain ownership of your uploaded photos. We claim no ownership rights over your photos.

Reproduction, redistribution, or reverse engineering of our Service without authorization is prohibited.

12. Privacy

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your information. By using the Service, you consent to our data practices as described in the Privacy Policy.

13. Termination

You may terminate your account at any time by contacting us or using the account deletion feature. We may terminate or suspend your access immediately, without prior notice, for any reason, including breach of these Terms.

Upon termination, your right to use the Service ceases immediately. Data retention shall follow the terms outlined in our Privacy Policy.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the Service shall be resolved in the courts of the United States.

15. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page with a revised "Last updated" date. Continued use of the Service after changes constitutes acceptance of the new Terms.

16. Severability

If any provision of these Terms is found unenforceable, that provision shall be severed, and the remaining provisions shall continue in full force and effect.
